Terms of Service

These Terms of Service ("Terms") govern your access to and use of Podflare ("the Service") at podflare.ai and through our APIs and SDKs. By creating an account or using the Service, you agree to these Terms on behalf of yourself and any organization you represent.

1. The Service

Podflare provides secure, isolated sandbox environments that execute code on demand through a programmatic interface. We may update, improve, or modify features at any time.

2. Your account

You are responsible for keeping your API keys and login credentials confidential. You are responsible for all activity that occurs under your account, including code your agents execute in your sandboxes. Notify us promptly if you suspect any unauthorized use.

3. Acceptable use

You agree not to use the Service to:

  • Violate any law or the rights of others.
  • Transmit malware, mount attacks against third parties, or interfere with the integrity of the Service or any other system.
  • Mine cryptocurrency, resell raw compute capacity, or otherwise use the Service in a way that is not its intended purpose.
  • Circumvent rate limits, quotas, authentication, or other technical restrictions.
  • Attempt to reverse-engineer, scrape, or exfiltrate other customers' workload data.

4. Plans, fees, and billing

Paid plans are billed monthly in advance at the rates shown on your billing page. Usage-based fees (compute time, data transfer, fork operations) are billed in arrears for the prior period. We will give you at least 30 days' notice before introducing a new fee or increasing an existing one for your current plan.

5. Your data; your rights in it

You retain all right, title, and interest in the code, files, and data you send to the Service ("Customer Data"). You grant us a limited, non-exclusive license to process Customer Data only to the extent necessary to provide the Service to you. We do not claim rights to the inputs or outputs of your sandbox executions. Our handling of personal information is governed by our Privacy Policy.

6. Intellectual property

The Service, including the software, APIs, documentation, and trademarks, is owned by Podflare and is protected by law. Except for the limited rights we grant you in these Terms, we reserve all right, title, and interest in the Service. You may not copy, modify, reverse-engineer, or redistribute any part of the Service, and you may not use our name, logo, or branding without our prior written permission.

7. Confidentiality

Each party agrees to keep the other's non-public information confidential and to use it only to exercise its rights or perform its obligations under these Terms. This obligation survives termination of the agreement.

8. Service level

We target 99.9% monthly uptime of the request-serving API. Live availability is published at podflare.ai/status. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Podflare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Podflare harmless from any claim, loss, or demand arising out of your breach of these Terms, your misuse of the Service, or Customer Data you submit that infringes a third party's rights.

11. Suspension and termination

You may close your account at any time from workspace settings. We may suspend or terminate access to the Service for any user that materially breaches these Terms, creates a security or compliance risk, or exposes other customers to harm. Where practical we will provide prior notice and an opportunity to cure. Sections that by their nature should survive termination (including 5, 6, 9, 10, and 12) will survive.

12. Governing law

These Terms are governed by the laws of Finland, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts of Helsinki, Finland, and you consent to the personal jurisdiction of those courts.

13. Changes

We may update these Terms. Material changes will be announced by email and posted on this page with a new effective date at least 14 days before taking effect. Your continued use of the Service after the new date constitutes acceptance.
